In December 1973, and January 1974, a number of persons were randomly shot and killed or injured on the streets of San Francisco.   Random shootings occurred again in April 1974.   In each instance the victim was a Caucasian and the gunman a Negro male.   Witnesses gave police various descriptions of the gunman's height, weight, and appearance.   In most instances, the gunman was described as 25 to 30 years old, about 6 feet tall, 160 to 180 pounds.   The San Francisco Police Department took extraordinary measures to identify the person or persons responsible for the shootings.   The police investigation of these crimes became known as “Operation Zebra,” based on the police radio code letters for that particular investigation.   This case has become known as the “Zebra” case.


In April 1974, the City of San Francisco offered a reward of $30,000 for information leading to the arrest and conviction of the person or persons involved in the “Zebra” crimes.   Police released to the news media two composite drawings of a suspect, and on April 18, 1974, those sketches appeared in local newspapers.   On April 22, 1974, Anthony Cornelius Harris telephoned the San Francisco Police Department and, during a number of interviews on successive days, Harris provided the police with information which led to the arrest (on May 1, 1974) and indictment of the defendants in this case.²  Although the defendants argued that Harris' main motive was revenge against the Black Muslims and collection of the reward, Harris said he telephoned the police primarily “to stop a lot of senseless killing, that's all.”

Police investigation did not focus on defendant until August 11, 1980, when Carol Mary Bundy, defendant's housemate, confessed to the murder of Jack Murray, her sometime lover. In the course of her confession, Bundy accused defendant of the killings. Defendant in turn theorized that Bundy committed the killings with Jack Murray, and then killed Murray in a plot to frame defendant for the Sunset murders.
The evidence against defendant was largely circumstantial and painstakingly pieced together through extensive police investigation. (Bundy did not testify for the prosecution, but only when called by the defense.) The story is further complicated by a morass of procedural machinations relating to defendant's representation. Accordingly, the facts must be set forth in some detail.

Steven David Catlin California

In 1986, in Monterey County Superior Court, petitioner was convicted of murdering Glenna Catlin, one of his ex-wives;  he was sentenced to life imprisonment without the possibility of parole.   In 1988, the Court of Appeal affirmed the judgment.  (People v. Catlin (June 13, 1988, H002078) [nonpub. opn.].) In 1990, in Kern County Superior Court, petitioner was convicted of murdering Martha Catlin (his mother) and Joyce Catlin (another ex-wife).   For Martha's murder, petitioner was sentenced to death;  for Joyce's murder, he was sentenced to life imprisonment without the possibility of parole.   In 2000, while petitioner's appeal from the Kern County Superior Court judgment was pending before us, he petitioned us for a writ of habeas corpus, challenging the judgment.   In 2001, we resolved the appeal by affirming the judgment in its entirety.  (People v. Catlin (2001) 26 Cal.4th 81.)   At that time, the habeas corpus petition remained pending.

In 2002, the Legislature enacted section 1054.9.   That statute permits a defendant sentenced to death or to life imprisonment without possibility of parole to obtain postconviction discovery from the prosecution of any materials that the defendant would have been entitled to receive at the time of trial, upon a showing that good faith efforts to obtain those materials from trial counsel were unsuccessful.

We affirm.
