Charla Lewis moved into an apartment in the Buena Vista Gardens apartment complex in the Clairemont area of San Diego in December 1989. Defendant was employed by Expo Builder Supplies beginning on January 10, 1990, usually working from 3:00 p.m. until midnight. Later in the year he was employed at Nacomm Communications.

Tiffany Schultz was murdered on January 12, 1990; Janene Weinhold was murdered on February 16, 1990, and Holly Tarr was murdered on April 3, 1990. All three victims were young, attractive White women who resided in or near the Buena Vista Gardens apartment complex. A resident of that apartment complex testified that in the interval between the Weinhold and Tarr murders, a man she identified as defendant followed her home and stared at her.

On July 13, 1987, Los Angeles Police Department Officer Darryl Lee and his partner responded to a call about a dead body lying in an alleyway behind a residence on East 27th Street. Upon arriving at the location, the officer observed the body of an African-American woman, naked from the waist down with her shirt pulled up over her bra. She was wearing only one sock and no shoes. None of her missing clothing was found in the alley. Lee noticed "drag marks . . . in the dirt" near the woman's feet. It appeared to Lee that the woman had been killed elsewhere and her body then dumped in the alley. The dead woman was later identified as Linda Alford by her daughter. 

Dr. Irwin Golden, now retired, testified that in 1987 he was a deputy medical examiner in the Los Angeles County Coroner's Office. His autopsy revealed that the cause of death was asphyxia as a result of manual strangulation. Alford had sustained multiple bruises near her jawline, hemorrhages in and around her eyes, and scratches and abrasions to her neck, some of which were caused by fingernails. Hemorrhaging beneath her scalp and temporal area was "characteristic of a blunt injury . . . a blow or a bump to the head," and was consistent with Alford having been punched in the head. The autopsy revealed hemorrhaging to Alford's voice box and hyoid bone, "the U-shaped bone at the base of the tongue which aids swallowing." All of these injuries had been caused prior to death. A toxicology report showed that Alford had consumed alcohol and cocaine prior to her death.

Physical evidence linked defendant to eight of the murders, but with respect to the remainder, the prosecution relied on the similarity of the modus operandi and the existence of the so-called death listcryptic notebook entries, penned by defendant, that the prosecution asserted represented the various victims.

In April 1991, Carol Spadoni lived with her mother Eva Petersen on Sanchez Street in Burlingame, in San Mateo County.   Spadoni was defendant's wife.   Their relationship had begun when Spadoni answered a personal ad defendant had placed in a newspaper.   They were married in 1982 at San  Quentin where defendant was an inmate.   Eventually, Spadoni wanted to end her relationship with defendant whom she described to a friend as “weird.”   She told the same friend she was afraid of defendant.

In the summer of 1990, Petersen telephoned Richard Muniz in Sacramento.   Muniz was a prison friend of defendant and through defendant had met Petersen and Spadoni.   After his release from prison, Muniz maintained a friendship with the two women.   Petersen asked Muniz to come to her house in Burlingame and pick up some belongings that defendant had sent to the women in anticipation of his release on parole.   Petersen told Muniz she did not want defendant on her property because she was afraid of him and afraid that he might harm her.   Muniz took the items and stored them in his own garage.

Around 7:30 p.m., Coffman and Marlow brought Novis to the residence of Richard Drinkhouse.   Drinkhouse, who was recovering from injuries sustained in a motorcycle accident and having some difficulty walking, was home alone in the living room watching television when the three arrived.   Marlow was wearing dress trousers;  Coffman was still wearing a dress;  and Novis wore jeans and a black and green top and had a suit jacket draped over her shoulders. Marlow told Drinkhouse they needed to use the bedroom, and the three walked down the hallway.   The women entered the bedroom.   Marlow returned to the living room and told Drinkhouse they needed to talk to the girl so they could “get her ready teller number” in order to “rob” her bank account.   Drinkhouse complained about the intrusion into his house and asked Marlow if he were crazy.   Marlow replied in the negative and assured Drinkhouse “there won't be any witnesses.   How is she going to talk to anybody if she's under a pile of rocks?”   Drinkhouse asked Marlow to leave with the women.   Marlow declined, saying he was waiting for Veronica to bring some clothing.   He told Drinkhouse to stay on the couch and watch television.
Knowing Marlow had a gun and having previously observed him fight and beat another man, and also being aware of his own physical disability, Drinkhouse was afraid to leave the house.   At one point, when Drinkhouse appeared to be preparing to leave, he saw Coffman, in the hallway, gesture to Marlow, who came out of the bedroom to ask where he was going.   Drinkhouse then returned to his seat on the couch in front of the television.
