To substantiate her defense further, petitioner's attorney sought
disclosure of evidence seized by investigators from her mobile home-in
particular, several letters petitioner sent to her husband. These
letters contained references to her husband's "hypnotizing eyes" and the
fact that petitioner had been hearing her husband's voice by mental
telepathy. One letter also contained the suggestion that petitioner
believed her letters might lead her husband to kill her. The prosecution
denied that it had such letters and the trial court denied petitioner's
request. The jury subsequently imposed a sentence of life without
parole. Although the trial judge found that petitioner "was
substantially influenced by her husband," he overruled the jury and
sentenced petitioner to death. Id., at 693.

After petitioner's conviction and sentence were affirmed on
direct appeal, Ex parte Neelley, 494 So.2d 697 (1986), her attorney
learned that the investigator who had seized the letters did not deliver
them to the appropriate law enforcement officials. Petitioner then
filed a motion for relief from conviction and sentence, contending,
inter alia, that the State's failure to disclose the seized evidence
violated her due process rights. As a preliminary matter, a state court
found that the investigator's failure to disclose the letters could be
imputed to the prosecutor. Brief in opposition 10. After reviewing the
letters, however, the court concluded that " 'there is no reasonable
probability that any of the evidence would have altered either the guilt
or punishment stage of petitioner's trial.' " Ibid.

“The Pelham police arrived at Mr. Duke's house and
discovered the bodies of four deceased persons: Defendant's father,

Hunt, age 29 years; Chelisa Hunt, age 6 years; and Chelsea Hunt, age 7

discovered Defendant had spoken to one Sarah Woodruff and had told her

drove his four children to the top of the Dauphin Island bridge and
threw each child off the bridge to the water 100 feet below. Danny's
body was discovered on January 12 in a marshy area approximately 12
miles from the bridge; Lindsey's body was discovered on January 15
approximately 18 miles from the bridge, in Mississippi; Hannah's body
was discovered on January 20 approximately 144 miles from the bridge, in
Louisiana; and Ryan's body was discovered on January 13 approximately
16 miles from the bridge. The medical examiner testified that all four
children were alive when they were thrown off the bridge; that Danny,
Ryan, and Lindsey died as a result of blunt-force trauma and asphyxia
due to drowning; and that the cause of Hannah's death was drowning.
Kieu Luong, Luong's common-law wife,1
testified that around 10:00 a.m. on January 7, 2008, Luong came to the
nail salon where she worked and asked her for money. She gave him $31,
she said, so that he could get gasoline for their van. Kieu stated that
after Luong left the salon she tried repeatedly to reach Luong by
telephone but was unsuccessful. At around 7:00 p.m. that evening she
finally spoke to Luong and he told her that he had left the children
with “somebody else,” a woman named “Kim.” (R. 1036.) Later that night
Kieu and Luong reported to police that the children were missing. The
next morning, Kieu said, she and Luong went to the police station and
were questioned separately by police. Kieu asked police if she could
speak with Luong. Luong then told Kieu that the children were all dead,
that he had thrown them off a bridge, and that he would take police to
the bridge.

Alan Eugene Miller is a serial killer

According to his appeal, On June 17, 2000, the jury returned an advisory verdict recommending
that Miller be sentenced to death. Thereafter, on July 31, 2000, the
circuit court accepted the jury's recommendation and orally sentenced
Miller to death by electrocution. However, the Court advised the
parties that as soon as it could it would enter written findings, as
required by Alabama law.
At the conclusion of the sentencing
hearing, Miller's trial counsel requested that the court appoint other
counsel to represent Miller on appeal, stating, “the reason being that I
need to be scrutinized as well as the facts in this case.” (R. 1473.)
The court granted trial counsel's request, and it appointed new counsel
to represent Miller on appeal. On August 1, 2000, Miller's newly
appointed appellate counsel filed a motion for a new trial on the ground
that the verdict was “contrary to law and the weight of the evidence.”

Dudley Wayne Kyzer was charged in a six-count indictment under
Alabama's Death Penalty Statute, § 13-11-1 through § 13-11-9, Code of
Alabama 1975 (Act No. 213, General Acts of Alabama 1975), for first
degree murder "wherein two or more human beings [were] intentionally
killed by the defendant by one or a series of acts."[1] & [1a] The
jury found the defendant "guilty of first degree murder with aggravated
circumstances as charged in the indictment," and fixed the punishment at
death. (R.p. 829) Thereafter, the trial court conducted a post
conviction hearing on the aggravating and mitigating circumstances
pursuant to § 13-11-3 et seq., Code of Alabama 1975. The trial judge
then set punishment at death by electrocution after making specific

At arraignment the appellant entered a plea of not guilty and not
guilty by reason of insanity. Pursuant to defense motion, appellant was

trial court's receipt of the results of the lunacy commission's study of
the appellant's mental condition pursuant to § 15-16-20, Code of
