The State's evidence tended to show that on January 7, 2008, Luong drove his four children to the top of the Dauphin Island bridge and threw each child off the bridge to the water 100 feet below. Danny's body was discovered on January 12 in a marshy area approximately 12 miles from the bridge; Lindsey's body was discovered on January 15 approximately 18 miles from the bridge, in Mississippi; Hannah's body was discovered on January 20 approximately 144 miles from the bridge, in Louisiana; and Ryan's body was discovered on January 13 approximately 16 miles from the bridge. The medical examiner testified that all four children were alive when they were thrown off the bridge; that Danny, Ryan, and Lindsey died as a result of blunt-force trauma and asphyxia due to drowning; and that the cause of Hannah's death was drowning.

Kieu Luong, Luong's common-law wife,¹ testified that around 10:00 a.m. on January 7, 2008, Luong came to the nail salon where she worked and asked her for money. She gave him $31, she said, so that he could get gasoline for their van. Kieu stated that after Luong left the salon she tried repeatedly to reach Luong by telephone but was unsuccessful. At around 7:00 p.m. that evening she finally spoke to Luong and he told her that he had left the children with “somebody else,” a woman named “Kim.” (R. 1036.) Later that night Kieu and Luong reported to police that the children were missing. The next morning, Kieu said, she and Luong went to the police station and were questioned separately by police. Kieu asked police if she could speak with Luong. Luong then told Kieu that the children were all dead, that he had thrown them off a bridge, and that he would take police to the bridge.

According to his appeal, On June 17, 2000, the jury returned an advisory verdict recommending that Miller be sentenced to death. Thereafter, on July 31, 2000, the circuit court accepted the jury's recommendation and orally sentenced Miller to death by electrocution. However, the Court advised the parties that as soon as it could it would enter written findings, as required by Alabama law.

At the conclusion of the sentencing hearing, Miller's trial counsel requested that the court appoint other counsel to represent Miller on appeal, stating, “the reason being that I need to be scrutinized as well as the facts in this case.” (R. 1473.) The court granted trial counsel's request, and it appointed new counsel to represent Miller on appeal. On August 1, 2000, Miller's newly appointed appellate counsel filed a motion for a new trial on the ground that the verdict was “contrary to law and the weight of the evidence.”

In 1982 the Clayton County Police Department responded to a call regarding the death of a child. Jenny Ann Wright, Mrs. Johnson's eleven-year-old daughter. The state crime lab performed an autopsy and determined that asphyxiation was the cause of death.

Mrs. Johnson was informed that she was a suspect in the death of her daughter Jenny and the deaths of her three other children; however, no action was taken against Mrs. Johnson until the case was reopened in 1988.[2] During an audio- and video-taped interview between Mrs. Johnson and an officer on July 3, 1989, at the Clayton County Police Department, Mrs. Johnson admitted killing her daughter and also admitted killing her son J.W. Taylor. She denied causing the deaths of her two other children, Wayne Bowen and Tabitha Bowen.

Initially, we note that the state introduced evidence of ten other alleged murders to aid in establishing appellant's identity as the perpetrator of the murders of Payne and Cater. See Division 4, infra. Appellant's first enumeration of error concerns the state's use of circumstantial evidence based on expert comparisons of textile fibers found in the appellant's environment with fibers discovered on the twelve victims' bodies. The state's experts testified that they believed certain of the fibers which were associated with the victims matched others which had been recovered from appellant's home and cars he had used, and they opined that these matches established an inference that Williams had been in contact with the victims before *750 their deaths. This opinion was relied upon by the prosecution to support the further inference that Williams had killed the victims. Appellant now claims that the state failed to adequately demonstrate the scientific reliability of the fiber methodology which was employed by its experts, and that admission of the evidence based on these principles and techniques was therefore error.

The record supports the following. On February 24, 2006, Sergeant Shawn Gallagher of the Epping Police Department received two phone calls from the family of Kenneth Countie. They reported that their son had been taken from Wilmington, Massachusetts, by the defendant. Gallagher knew the defendant, having dealt with her approximately two dozen times since 1995.

Gallagher confirmed through the National Crime Information Center (NCIC) that the Wilmington Police Department listed Countie as a missing person. At around 1:00 p.m., Gallagher and Detective Richard Cote went to the defendant's home in Epping to check on Countie.

The defendant's home was located on Red Oak Hill Lane, a public dirt road. The road continued through the defendant's property, although there was a gate in front of the defendant's home, that, when closed, blocked the road. On her property were a single-family dwelling with a barn, outbuildings, and pastureland. Her property was bordered by a fence, barbed wire, and the gate between her property and the road.
