We further find that the defendant was entitled to challenge the admissibility of physical evidence seized when he was arrested. The record reveals that after the Huntley hearing had been conducted and subsequent to jury selection, the People revealed that they intended to introduce certain physical evidence seized at the time of the defendant's arrest. The defense counsel once again raised the issue of the Puerto Rican arrest warrants and requested permission to challenge the legality of the seizure of the evidence at a pretrial hearing. The court denied the application, concluding that probable cause for the arrest had already been established at the prior suppression hearing at which a different Judge had presided.

Since the defendant had been improperly precluded from examining the arrest warrants and challenging their validity, he was never afforded a full and fair opportunity to litigate the issue of probable cause and, thus, whether the evidence recovered at the time of his arrest had been legally seized. Accordingly, the court's reliance upon the prior suppression ruling, in denying the defendant's request for a hearing in connection with the admissibility of the physical evidence, constituted error (cf., People v Aguilera, 82 N.Y.2d 23, 31). Under the circumstances, the defendant should have been afforded the right to challenge the seizure of the physical evidence at a pretrial suppression hearing.

On May 12, 2003 the Graham County Sheriff in Arizona was notified of an unusual discovery in a locked storage bin #6 that had been opened by the landlord because the renter, Diane O'Dell, the defendant herein, had defaulted in her lease agreement. Three dead and "mummified"[FN1] infant bodies were discovered in three cardboard boxes, along with numerous personal and household items and family photographs, in the storage unit in Safford County, Arizona. Pursuant to that discovery, the Arizona authorities began a police investigation regarding the remains of the three infants [FN2] which led them to the Commonwealth of Pennsylvania where Diane O'Dell was currently residing with her paramour and children. The Arizona and Pennsylvania State Police investigations revealed that the Arizona storage unit had been rented [*2]by Ms. O'Dell for over ten years, and that Ms. O'Dell had also lived in Sullivan County, New York for an extended periods of time and had several other children born here.

The defendant had a total of eight children born alive in hospitals and raised by her at home. Of these eight, three were the issue of her marriage to James O'Dell and were born in 1978, 1979, and 1981. The other five children were born between 1986 and 1999 and were the issue of her live-in relationship with Robert Sauerstein her current significant other.

From 1990 until 1996, the police conducted extensive investigations in an effort to find the so–called "Zodiac Killer." In particular, on June 1, 1990, the police set up a "Zodiac Task Force," which consisted of approximately 65 detectives assigned exclusively to the investigation of this case. This task force was disbanded on November 30, 1990. On August 8, 1994, following additionalshootings allegedly committed by The Zodiac, the police established a second task force of 25 detectives. This second task force was disbanded on April 30, 1995. The People maintain, however, that investigation of the case continued until the arrest of defendant on June 18, 1996. Defendant was indicted on August 20, 1996.

In Supreme Court, as part of his omnibus motion, defendant moved to dismiss counts one through ten of the indictment, relating to the two March 1990 shootings. Defendant argued that, because the prosecution was not commenced until over six years after the alleged crimes, these charges were time–barred by the applicable five–year statute of limitations ( see, CPL 30.10[2][b]). The People countered that the running of the statute of limitations was tolled by CPL 30.10(4)(a)(ii), which excludes from the period of limitations any time during which the defendant's "whereabouts" are "continuously unknown and continuously unascertainable by the exercise of reasonable diligence." The People assert that because they were continuously unaware of the defendant's identity as the alleged perpetrator, they were thus also continuously unaware of his whereabouts, notwithstanding the considerable efforts of the police to find him.

The claim asserts three causes of action. The first cause of action alleges that from September 10, 2013, continuing through the date of the claim and ongoing, claimant "has been on a deprivation order in the nature of a cell shield on his cell door" (Claim number 127521, ¶ 2). The claim alleges that claimant was not given notice, a hearing, a misbehavior report or a deprivation order warranting a cell shield, that the cell shield was placed without just cause and without privilege, that claimant has a liberty interest, and that claimant was conscious of the cell shield. The second cause of action alleges that DOCCS Directive 4933 affords due process only to mentally ill inmates before the imposition of a deprivation order cell shield and discriminates against inmates who are not mentally ill. The third cause of action alleges that in January 2016, claimant provided notice to various DOCCS officials that their actions in imposing the cell shield violated the New York constitution, and that their failure to remedy the violations constituted a violation of their oath to support the New York constitution. The claim seeks monetary damages for cruel and unusual punishment, negligence, denial of due process and mental and emotional anguish.

Among the numerous stories that ABC was following was the homicide of Ramona Moore, one of the victims in this case.   ABC followed and filmed the investigators in this case while the police tried to solve the crime.   A break came when a person named Raymondo Jack (Jack) gave certain information to the police.   Additionally, the police were able to connect the murder of Ms. Moore to an alleged rape/kidnaping of SB.   As a result of all the information gathered the defendant was arrested.

On July 13, 2004, an episode of NYPD 24/7 was aired containing taped interviews with the detectives in charge, the family of Ms. Moore, SB and Jack.

The defendant Pearson wishes to have all the unused film from the program to see if any of the witnesses will, while testifying for the People, contradict anything that the witness stated on the unused film.   They seek the outtakes for possible impeachment material.   The defendant Pearson can neither identify any inconsistent statement nor does he identify a single piece of outtake that he will introduce into evidence during the trial or other proceeding.

The following facts, as reasonably could have been found by the jury, and procedural history are relevant. This case involves a love triangle between the defendant and two of her coworkers at Purdue Pharma, a pharmaceutical company in Stamford. The defendant became obsessed with Nelson Sessler, one of her coworkers. The victim was Anna Lisa Raymundo, the second coworker, who ultimately lived with and became the girlfriend of Sessler. In late 2000, Sessler met Raymundo at an after-work happy hour that other coworkers also attended. In the summer of 2001, the defendant met Sessler for the first time at another after-work happy hour. Although the defendant was married to Christos at the time, she told Sessler that she was divorced. At some point, Sessler began sexual relationships with both the defendant and Raymundo.

During the tenure of the defendant's relationship with Sessler, the two met periodically at the condominium unit in Pleasantville, New York, where the defendant lived with Christos. Before Sessler would meet the defendant at the Pleasantville condominium unit, the defendant would tell Christos that her mentally ill brother was coming to visit and Christos had to leave the house and take his personal belongings with him. The defendant told Christos that her brother might react badly if he discovered that she was married. Christos believed this story at first. He knew from the defendant's parents that the defendant, in fact, had a mentally ill brother. According to Sessler, he and the defendant did not see each other often because the defendant was “busy” with other obligations and interests, including volleyball and taking care of her mentally ill brother.
