His appeal includes:  Petitioner was an Army Specialist stationed at Fort Bragg, North Carolina. On December 15, 1986, he abducted, raped, sodomized, and murdered Private Laura Lee Vickery-Clay. On January 3, 1987, he raped and attempted to murder Private Mary Ann Lang Nameth. Three days later, on January 6, he raped, sodomized, robbed, and murdered civilian Kimberly Ann Ruggles. Pet. App. 169a-171a. The court-martial evidence established the following facts: The first victim, Private Vickery-Clay, disappeared from Fort Bragg on December 15, 1986. On that date, two witnesses saw her at a local K-Mart with a man later identified as petitioner. Vickery-Clay's car, found the next morning a block from her home, appeared to have been driven through the woods, and the driver's seat was set back farther than needed for Vickery-Clay to drive. Three fingerprints that matched petitioner's prints were found on the hood of the car. On January 17, 1987, another soldier discovered Vickery-Clay's half-naked, decomposed body in the woods in Fort Bragg. She had been raped, sodomized, and shot in the neck, forehead, chest, and back of the head. She had also suffered blunt force trauma to various parts of her body. The murder weapon-a .22 caliber pistol that petitioner had stolen in November 1986-was found approximately 60 feet from Vickery-Clay's body. Pet. App. 170a-171a; Gov't C.A. Br. 6 & n.5, 7

This is a federal capital case arising from the events occurring in the spring of 2005 when the Petitioner, Joseph Edward Duncan III, traveled from North Dakota to Idaho on an orchestrated crime spree looking for children to abduct, abuse, and kill.² On May 16, 2005, Duncan carefully choose his victims when he broke into a rural home near Coeur d'Alene, Idaho and savagely killed three individuals living at the home and kidnapped two of the minor children — S.G. and D.G. — who were eight and nine years old at the time. Duncan took the two children to a secluded campsite in the Lolo National Forest in Montana that he had chosen for its privacy where, for the next several weeks, he inhumanely tortured, raped, and sexually assaulted both children. Duncan eventually killed D.G. at the campsite. On June 22, 2005, Duncan returned to Coeur d'Alene, Idaho with S.G. and he was apprehended when an employee of the restaurant where he and S.G. were eating identified the two and called law enforcement.

The State of Idaho charged Duncan with three counts of kidnaping and three counts of murder relating to his killings of the three individuals at the Coeur d'Alene home. Duncan plead guilty to the state charges on October 16, 2006.

He was described as at one point being the "chief assassin" for the Cartel's leader Pablo Escobar. He was believed to be responsible for the deaths of an unknown number of people with official estimates ranging in the hundreds, US authorities currently link him to the deaths of more than 220 people, having supposedly murdered members of both his own organization the Medellín Cartel and the rival Cali Cartel, as well as police officers and government officials. Colombian authorities connect him to the deaths of more than 40 police officers. Among his convicted crimes is the 1989 bombing of Avianca Flight 203, which killed 110 civilians.
